Call-Now ("us", "we", or "our") operates the www.call-now.co.uk website and a Secure Call Recording service to various organisations (the "Service").

4.3 you will at all times comply with the Law and only use the Services for your personal use or internal business requirements and not on behalf of any other person;
4.4 you will comply with all reasonable instructions issued by us with respect to the use of the Services;
4.5 you are solely responsible for giving any party to a telephone conversation that is subject of a Recording any and all necessary warning(s) or notice(s) of the Recording and the use that will or may be made of the Recording and the Personal Information and other information contained therein, and obtaining the express or implied consent of all parties to the call as required by Law;
4.6 you will secure Recordings and Personal Information against misuse, loss, unauthorised use, modification or disclosure and destroy or permanently de-identify Personal Information if no longer needed for any purpose for which the information may be used or disclosed, as authorised or as required by Law;
4.7 you will notify us immediately once you become aware of any unauthorised use of the Services;
4.8 you have made your own enquiries regarding your obligations under the Law (including, but not limited to, whether the Privacy Act is applicable to you) and that we has no obligation to advise you of such obligations;
5. ACCESS PIN
5.1 You will be provided with an Access Pin being a 6 digit number that’s allows you to retrieve your call recording. The safe keeping of this Pin is your sole responsibility
5.2 You undertake not to disclose the Access Pin to any third party and to take all reasonable measures to prevent disclosure of the Access Pin to any third parties. In the event that disclosure is made then we are entitled to exercise its rights under clause 9.
5.3 You must notify the "company" immediately once you become aware of any unauthorised disclosure or use of the Access Pin
6. PROVISION OF SERVICES
6.1. Fees and Payment
(a) In consideration for us providing the Services, you will be charge using your telephone billo at the rate stated on the web site or by reverse bill SMS at the rate stated on the web site.
(b) The applicable Fees shall be the amounts stipulated on nthe web site
(c) Any Usage Charges payable for telephone calls and all other Services or goods supplied in addition to your call charges shall be billed on your telephone bill.
6.2 Force Majeure
If any circumstance, matter or thing beyond our control (including, but not limited to, strikes, lock outs, acts of terrorism, fire, flood or drought) We are unable to supply the Services in whole or in part then it will be relieved of that obligation to the extent and for the period that it is so unable to perform and will not be liable to you in respect of such inability.
6.3 User Responsibilities:
(a) In using any of our Services you are responsible for your actions and the actions of any person you have authorised to use our Services through your Account.
(b) You are responsible for all charges incurred from the use of our service.
(c) If you act recklessly or irresponsibly in your use of our Services or your actions endanger any person or the integrity or security of our network, systems or equipment, your access may be restricted, suspended or terminated without prior notice.
(d) You agree that you will not use, attempt to use or allow your Services to be used to:
(i) store, send or distribute any content or material which is restricted, prohibited or otherwise unlawful under any applicable Law, or which is likely to be offensive or obscene to a reasonable person;

7.1 You are responsible for ensuring that your own business information and information technology systems are protected against the actions of third parties; and
7.2 We do not recommend that you use the service to call organisations that will disclose financial information on the call recording.
8.3 You are responsible for maintaining the security of your Service, including protection of Account details, passwords and protection against unauthorised usage of your Service by a third party. You are responsible for all charges incurred by other persons who you allow to use your Service, including anyone to whom you have disclosed your Account details.
9. SUSPENSION, CANCELLATION AND TERM/TERMINATION
The "company" may, without liability and with immediate effect, suspend the Services:
(a) if we have given you notification that a Service is being used for a purpose which does not comply with these Terms;
(b) to comply with any lawful order, direction or determination of any regulatory body with jurisdiction over us or the Services and that in the event this occurs, you will not be entitled to any refund for any charges nor will we be liable for any loss or damage to you or any third party clients or end users of your business;
Without prejudice to its other rights, We may terminate its provision of the Services to you immediately on written notice to you and/or your access to the Site if:
(a) you commit a breach of these Terms that is capable of being remedied and you do not rectify the breach within 5 days of being notified in writing of the breach;
(b) you commit a breach of these Terms and Conditions that is not capable of being remedied;
(c) an event occurs which results in the "company" being unable, in its reasonable opinion, to continue to provide the Services to ou (such as a change in any Law);
(d) you become insolvent; or

9.4 Consequences of Cancellation and Termination
(a) If the Services are cancelled or terminated for any reason before the end of the period for which you have prepaid Fees, your Account will be Deactivated and you will not be entitled to any refund for those prepaid Fees
(b) All clauses of these Terms that are capable shall survive termination or expiration of the provision of the Services.
11.1 To the extent permitted by law, you agree to indemnify us and its employees, officers, servants or agents against any claim, loss, liability or damage, costs, charges and expenses (including our legal costs on a solicitor/ own client basis) suffered or incurred by us which arise directly or indirectly in relation to:
(a) any breach by you or your employees, officers, servants or agents of any provision of these Terms or of any Law;
(b) any act or failure to act, negligent or otherwise, by you or any of your employees, officers, servants or agents;
(c) you or your employees, servants or agent’s unlawful use, misuse, unauthorised access, modification or disclosure of a Recording or Personal Information, except to the extent that any such Loss is caused by the negligence or other wrongful act of the "company" or its employees, officers, servants or agents; and
(d) any other use of the Site or the Services in violation of these Terms.
11.2 The indemnities contained in these Terms and Conditions:
(a) are continuing obligations, independent from your other obligations under these Terms and any Law; and
(b) continue after the provision of the Services has ceased.
12. NOTICE OF BREACH
You agree to promptly inform us of any breach, or suspected breach, by you of these Terms and of any conduct of any other person which you think may be a breach of these Terms, whether the conduct has ceased, is continuing, or may occur in the future.
13. INTELLECTUAL PROPERTY
